    I Didn’t See Anything.. Virginia’s Disclosure Form

    VA DisclosureSellers in every state are required to disclose to future owners items they know about the home that could negatively affect the property. 

    In Northern VA, sellers have the same guideline.  However, 99% (my made up percentage) of the time sellers sign a disclosure form where they claim ignorance to the following issues or make no representation and warranties regarding the following issues….

    • To the condition of the home or improvements made to it.
    • To any matters pertaining to adjacent properties.
    • To whether the home is affected by any historical district  or ordinances.
    • To whether the home has resources affected by the Chesapeake Bay Preservation Act.
    • To any information regarding sexual offenders.
    • To whether the property is in a dam break zone.
    • To whether the property has a storm water detention facilities located on it.
    • To whether there is a waste water system on the property.
    • To whether there are any pending enforcements actions pursuant to the Uniform Statewide Building Code that affect safe, decent, and sanitary living conditions.

    The disclosure form encourages purchasers on each of the above items to do whatever due diligence they deem necessary prior to settlement to feel comfortable regarding these items. 

    Sellers often sign this form instead of outlining every minor detail they may know is questionable in the home and leave the rest up to the buyer and their home inspector.  If a seller does have knowledge of of major items and does not disclose it, there can be legal ramifications.   However, it can be difficult to prove after settlement that they were covering it up so buyers be ware!  Do your homework!
